The subjects of the European nations who were provided with ahidnames by the Ottoman Empire were called musta'man. Thanks to ahidnames that were given to them, mustamans were able to reside and trade in the Ottoman territory as well as they were able to apply to the Ottoman courts for litigation. Following Venice and Genoa, France, England and the Netherlands started to obtain more ahidnames in the late 16. century, thus strengthening their position in the Levantine market. Musta'mans were resolving their internal disputes generally through their own consuls. On the other hand, according to ahidnames, they were required to apply to the Ottoman judiciary for any disputes with the Ottoman subjects. There is a relatively small number of the cases regarding mustamans that can be found in the Istanbul Sharia Court records. A survey of 30 record books of Istanbul courts from the various points of the 17th century reveals that most of the court records concerning musta'mans are the registrations of the legal transactions of the musta'mans . And approximately twenty percent of the records are about lawsuits. Even though the cases generally stemmed from disputes between musta'man merchants and Ottoman subjects, there are also examples of intra-musta'man litigations. Most of the records regarding musta'mans are about matters such as debtor-creditor relationships, sale contracts and partnerships. Issues related to surety and power of attorney which needed to be recorded by virtue of shariah and ahidnames are also frequently found in the court records. Although the sharia law was applied in the trials, some privileges provided by ahidnames were constantly being referred to by the musta'man in their court appearances.. Especially some of the privileges concerning burden of proof, jurisdiction claims, and some exemptions were quite in favor of the musta'man. Additionally, musta'man supported their claims in the court with the fatwas of Grand Mufti. The cases examined in this paper demonstrates that musta'man were able to access to the courts in the face of legal disputes and defend their cases through various means. As it was further observed through the cases studied, the Ottoman kadis were abiding by ahidnames and protecting the musta'man merchants' commercial activities.

Osmanlı İmparatorluğunda müste'men, ahidnâme verilen Avrupa devletleri teb'asına verilen isimdir. Ahidnâme sayesinde Avrupalı tüccarlar ve onların bayrağı altında bulunanlar; Osmanlı ülkesinde ikamet edebilir, ticaret yapabilir, mahkemelere başvurabilirdi. Venedik ve Ceneviz'in ardından 16. yüzyılın sonundan itibaren Fransa, İngiltere ve Hollanda ahidnâmeler elde ederek Levant ticaretinde güç kazanmıştır. Müste'men tüccarlar kendi aralarındaki uyuşmazlıkları genellikle konsoloslar vasıtasıyla çözmekteydi. Ahidnâme gereği Osmanlı teb'ası ile olan uyuşmazlıkları için Osmanlı mahkemelerine başvurmaları gerekiyordu. İstanbul şer'iyye sicillerinde oran olarak az miktarda müste'men tüccar kaydına rastlanılmaktadır. 17. Yüzyılın çeşitli dönemlerine ait incelenen yaklaşık 30 defterde karşılaştığımız kayıtların büyük bir bölümü müste'menlerin hukukî muamele tescildinden oluşmaktadır. Bunların yaklaşık %20'si ise davalardır. Davalar genellikle müste'men ile Osmanlı tebası arasında olmakla birlikte iki müste'men arasındaki davalara da rastlanılmıştır. Müste'men kayıtları borçlanma ilişkileri, alım-satım ve ortaklık ilişkileri gibi konularda ağırlık kazanmaktadır. Yine şer'iata ve ahidnâmeye göre tescil zorunluluğu olan kefalet, vekalet gibi hususlar da çoktur. Muhakeme şeriatın hükümlerine göre yapılmakla beraber ahidnâmedeki bazı imtiyazlar müste'menler tarafından sürekli öne sürülürdü. Bunlar arasında özellikle belge ile ispat zorunluluğu, yetkisizlik iddiası ve bazı muafiyetler mahkemede üstünlük sebebi idi. Müste'menler davalar esnasında sıkça ahidnâmeyi destekler nitelikte şeyhülislâm fetvalarını da mahkemeye sunmuşlardır. Müste'menlerin ticari hayatta yaşanan anlaşmazlıklarla bağlantılı olarak mahkemelere etkin olarak başvurabildiklerini, ve davayı kazanmak için bir çok vasıtayı kullandıklarını söylemek mümkündür. Davalardan anlaşıldığı kadarıyla Osmanlı kadıları ahidnâmelere bağlı kalarak müste'men tüccarların ticari faaliyetlerini gözetmektedir.
