Abstract

This paper is based on ? The Universal Museum Declaration? published in England by the predominant museums of the world in December 2002. While discussing the declaration in its many aspects, the main focus was given to the question whether the declaration actually violated the cultural rights or not. There have been two common approaches to ?The Universal Museum Declaration? since it was published: The first one is the universalist approach, which claims that cultural heritage belongs to the entire humanity and hence the universal heritage/world`s culture heritage shall be protected uniformly while the second one is the nationalist approach which holds that a certain cultural heritage belongs to a nation. While ?The Declaration of Universal Museum? is discussed around these two views, many problems that lie on the basis of current situation remain intact. To begin with, there is already a huge paradox in naming the formulas as so called solutions and the concepts that are used. Even more importantly, ?The Declaration of Universal Museum? seems to be violating cultural rights according to `The Universal Declaration of Human Rights ` and `Indigenous People's Rights`. The publication date of the declaration and the fact that those who signed the declaration are from a certain circle of interest also support this thesis.
