Abstract

The crime of rigging during the discharge of the contractual obligation is regulated under ninth section entitled `Crimes Related to Economy, Industry and Trade`, under third part headed `Crimes Against Society`, under second book which involves special provisions of Turkish Criminal Code No. 5237. By the section of the provision, the crime of rigging during the discharge of the contractual obligation constitutes an economic crime. The second paragraph of the article 236 stipulates the fraudulent acts of rigging during the discharge of the contractual obligation as delivering or accepting a product differ from the one specified its quality in the contract, delivering or accepting a product less than indicated, accepting the execution of the contractual obligation as prompt even though it is not fulfilled within the specified period, accepting the execution although it is not conformed with the specified conditions, amount or quality in construction bids and accepting the execution of the service despite its inconvenience by quality or quantity. Lastly the third paragraph of the article disposes that the public officers who afford advantage by the act of acceptance above-mentioned have to be punished for both of the crimes.

Edimin ifasına fesat karıştırma suçu, 5237 sayılı Türk Ceza Kanunu'nun özel hükümleri içeren ikinci kitabının `Topluma Karşı Suçlar` başlıklı üçüncü kısmının `Ekonomi, Sanayi ve Ticarete İlişkin Suçlar` başlıklı dokuzuncu bölümünde düzenlenmektedir. Düzenlendiği bölüm itibariyle edimin ifasına fesat karıştırma suçu ekonomik suç özelliği göstermektedir. 236. maddenin ikinci fıkrasında edimin ifasına fesat karıştırma olarak kabul edilen fiiller, hileli hareketlerle niteliği belirtilen maldan başka bir malın teslim veya kabul edilmesi, belirtilen miktardan eksik malın teslim veya kabul edilmesi, edimin belirtilen sürede ifa edilmemesine rağmen süresinde ifa edilmiş gibi kabul edilmesi, yapım ihalelerinde eserin veya malzemenin belirtilen koşul, miktar veya niteliğe uygun olmamasına rağmen kabul edilmesi ve hizmet niteliğindeki edimin nitelik veya nicelik açısından uygun olmamasına rağmen kabul edilmesi olarak sayılmaktadır. Maddenin üçüncü fıkrasında ise edimin ifasına fesat karıştıran kamu görevlileri için bir gerçek içtima hükmü getirilmekte ve bu fiilleri dolayısıyla menfaat temin eden kişilerin ayrıca ilgili suç hükmüne göre cezalandırılacakları öngörülmektedir.
