The history of literature beginning on the stones and papyrus plants upon the invention of writing is living its new revolution now with the digital technology entering into our life after the radical change upon the invention of the press. In the 21st century, when we are in the knowledge era, the reproduction of the scientific and literal works in seconds and the easy storage of the complete works in thousands of pages have caused radical changes in the customary publishing habits. Upon the appearance of the electronic books, the legal conflict and the doctrinal discussions have become severe between the author, publisher and reader. In our present study, it is aimed to consider the electronic books comprehensively in terms of the law on intellectual and artisitc works and to include the electronic books in the discussions on the digital works. While evaluating the electronic book application and the legal problems arising, it is attempted to assess how much the doctrinal opinions on the digital works and the customary rules on the printed books comply with electronic books.While considering the electronic book and the legal problems arising, which constitutes the subject of our present study, the concept of electronic book, its advantages and disdvantages and the concept of work and the intellectual rights on the electronic book are generally reviewed. The continuing discussions are based on whether the right of distribution or the right of communication to the public will be in question for placing the electronic book in the digital format to the commercial position. In the second section of our present study, the e-book publishing agreement is considered in terms of the law of obligations and Turkish Code of Obligations with number 6098, the Law on Intellectual and Artisitc Works (FSEK) with number 5346, German Copyrights Law (UrhG) and German Publishing Law (VerG) are reviewed comparatively. In the last section of our present study, the disposal on the electronic book, on which the current discussions are going on, and the problem of renting of the electronic book and lending of it to the public are evaluated. While making this evaluation, UsedSoft v. Oracle decision of the Court of Justice of European Union dated 3rd July 2012 and Vereiniging Openbare Bibliotheken v. Stichting Leenrecht decision of the Court of Justice of European Union dated 10th November 2016 are examined.

Yazının icadıyla birlikte taşlar ve papirüsler üzerinde başlayan yazın tarihi, matbaanın icadıyla geçirdiği köklü değişimden sonra şimdi de dijital teknolojilerin hayatımıza girmesiyle yeni devrimini yaşamaktadır. Bilgi çağında olduğumuz 21'inci yüzyılda ilim ve edebiyat eserlerinin saniyeler içinde çoğaltılabilmesi, binlerce sayfalık külliyatların kolayca depolanabilmesi klasik yayıncılık alışkanlıklarında köklü değişimlere yol açmıştır. Elektronik kitapların ortaya çıkmasıyla birlikte yazar, yayıncı ve okuyucu arasındaki hukuki çekişme ve doktriner tartışmalar da şiddetlenmiştir. Çalışmamızda elektronik kitapların fikir ve sanat eserleri hukuku yönünden kapsamlı şekilde ele alınması ve dijital eserlere ilişkin tartışmalara elektronik kitapların da dahil edilmesi amaçlanmıştır. Elektronik kitap uygulaması ve getirdiği hukuki sorunlar değerlendirilirken dijital eserlere ilişkin doktriner görüşlerin ve basılı kitaplara ilişkin klasik kuralların elektronik kitaplara ne derece uyduğu değerlendirilmeye çalışılmıştır. Çalışmamızın konusunu oluşturan elektronik kitap ve getirdiği hukuki sorunlar ele alınırken ilk bölümde genel olarak elektronik kitap kavramı, avantaj ve dezavantajları ile eser kavramı ve elektronik kitap üzerindeki fikri haklar incelenmiştir. Dijital formattaki elektronik kitabın ticaret mevkiine konulmasında yayma hakkının mı yoksa umuma iletim hakkının mı söz konusu olacağı süregelen tartışmaların temelinde yer almaktadır. Çalışmamızın ikinci bölümde borçlar hukuku bağlamında e-kitap yayın sözleşmesi ele alınarak 6098 sayılı Türk Borçlar Kanunu, 5346 sayılı Fikir ve Sanat Eserleri Kanunu (FSEK), Alman Telif Kanunu (UrhG) ve Alman Yayın Kanunu (VerG) karşılaştırmalı olarak incelenmiştir. Çalışmanın son kısmında ise güncel tartışmaların devam ettiği elektronik kitap üzerinde tasarruf işlemleri ve elektronik kitaplarda kiralama ve kamuya ödünç verme sorunu değerlendirilmiştir. Bu değerlendirme yapılırken Avrupa Birliği Adalet Divanı'nın 3 Temmuz 2012 tarihli UsedSoft v. Oracle kararı ve Avrupa Birliği Adalet Divanı'nın 10 Kasım 2016 tarihli Vereiniging Openbare Bibliotheken v. Stichting Leenrecht kararı da mercek altına alınmıştır.
