Abstract

In accordance with Article 9 of the Labor Law No. 4857, employment contracts are generally made for a fixed-term or an indefinite term. According to the Labor Law norms, the conclusion of the contract for an indefinite term is the rule. However, it may be possible for the job to continue for a certain period of time by nature, or to decide to establish the relationship for only a certain period of time. A fixed-term employment contract may be defined as an employment contract signed in a written form between the employer and the employee for a periodical job or depending on the objective conditions, such as the completion of a specific job or the occurance of a particular case. In today's work life, the tendency of employers to make a fixed-term employment contract has led to the disagreement in each stage of the fixed-term employment contract. The indefinite term employment contract is accepted as main contract due to the deprivation of the employees who work with fixed-term employment contracts from job security provisions and receivables arising from the termination. In particular, the inadequate regulations in the period of the Code of Obligations (818) led to discussions in Doctrine. These discussions are given in detail in our study and a solution proposal has been proposed under the Turkish Code of Obligations.
