Abstract

Books that contain all legal cases related to people, judgements of the decisions of the kadis and various written records dealing with the judiciary are called as şer'iyye sicils, kadı books, court books or register books. In other words they are the books that are kept in the courts and all kinds of official records are collected.The thesis are have prepared contains the translation and analysis of Sivrihisar's heritage book number 58. Our study begins with the geographical stuation and historical processes of the Sivrihisar region and continues with the prosperity of the şerʼiyye sicils. Since all of our study is made up of heritages and court cases, the first heritages are mentioned and explained more broadly. Afterwards, the book is assessed and the summary of the provision is given.In the book, we also found information on the socio-economic and cultural life of Sivrihisar, as well as clues and reflections oft he diplomatic and content features that lived after the Tanzimat. In this respect, transcription and analysis will be the basis for other studies.

İnsanlarla ilgili bütün hukuki olayları, kadıların verdikleri karar sûretlerini ve yargıyı ilgilendiren çeşitli yazılı kayıtları içeren defterlere şer'iyye sicilleri, kadı defterleri, mahkeme defterleri veya sicillât defteri denmektedir. Diğer bir ifade ile şer'iyye sicilleri; mahkemelerde tutulan, resmi statü taşıyan her türlü kayıtların toplanmış olduğu defterlerdir. Hazırlamış olduğumuz tez, Sivrihisar'a ait 58 Numaralı Şer'iyye Sicili'nin çeviri yazısı ve tahlilini içermektedir. Çalışmamız Sivrihisar bölgesinin coğrafi durumu ve tarihsel süreçleri ile başlamakta ve şer'iyye sicillerinin önemi ile devam etmektedir. Çalışmamızın tamamı terekelerden oluştuğu için ilk olarak terekelere yer verilmekte ve daha geniş anlatılmaktadır. Sonrasında defterin değerlendirmesi yapılmakta ve hüküm özetleri verilmektedir. Defterde Sivrihisar'ın sosyo-ekonomik ve kültürel hayatına dair bilgiler olmakla birlikte, Tanzimat sonrasında yaşanan diplomatik ve içerik özelliklerinin ipuçları ve bunların yansımalarını görmekteyiz. Bu bakımdan defterin transkripsiyon ve tahlili diğer çalışmalar için zemin oluşturacaktır.
