 ملخص:. 
تهدف هذه الدراسة إلى استعراض إحدى أهم الضمانات التكميلية التي تضمن التطبيق الفعال لأحكام الاتفاقيات الجبائية لمنع الازدواج الضريبي، و المتمثلة في إجراء التجكيم الذي أنشأته المنظمات الدولية بغرض حل النزاعات التي تثور عند تطبيق أو التفسير الخاطئ لتلك الاتفاقيات. أين يستفيد المكلف بالضريبة من هذا الإجراء ضمن حالات معينة و في ظل قواعد إجرائية مفصلة. قمنا بوصفها و تحليلها لنستنتج في الأخير أن هاذ النوع من التحكيم هو تحكيم استثنائي و بديل إضافي لحل المنازعات الجبائية الدولية، يتطلب تطبيقه اللجوء أولا إلى إجراء آخر هو الاتفاق المتبادل. و على الرغم من الدور الذي يلعبه هذا الإجراء الا أن العديد من الدول و من بينها الجزائر تستبعد إدراجه ضمن نصوص اتفاقياتها الجبائية، مما يستوجب عليها إعادة التفكير في موقفها هذا، و محاولة مواكبة التطورات الدولية التي يعرفها مجال الجبائي الدولية.
Abstract :
This study aims to review one of the most important complementary guarantees, that ensure the effective implementation of the taxation agreements' provisions to prevent double taxation, which represented in the arbitration procedure established by international organizations for the purpose of resolving disputes that arise upon the application or the misinterpretation to those agreements. Where does the taxpayer benefit from this procedure within certain cases and under detailed procedural. We have described and analyzed it, to conclude finally that this type of arbitration is an exceptional arbitration and an additional alternative for resolving international taxation disputes. Its application requires first the resorting of another procedure which is mutual agreement, inspite of the role played by this procedure, many countries including Algeria, exclude its inclusion in their taxation agreements texts. Which requires it to rethink about its position، and try to keep up the international developments known in the field of taxation. 
Résumé : 
Cette étude vise l'une des garanties complémentaires qui garantissent la bonne application des conventions fiscales d’éviter la double imposition; c’est la procédure d'arbitrage créer par les organisations internationales aux fins de résoudre les litiges résultent de l'application ou mal interprétation de ces accords. Où le contribuable bénéficie-t-il de cette arbitrage selon des règles procédurales. Nous l'avons décrit et analysé pour conclure à la fin que ce type d'arbitrage est exceptionnel et alternative supplémentaire à la résolution des litiges fiscaux internationaux, dont l'application nécessite en premier lieu le recours à l accord amiable. mais Malgré le rôle que joue cette procédure, de nombreux pays, dont l'Algérie, excluent son inclusion dans les textes de leurs conventions fiscales. ce qui les oblige à repenser leur position, et à essayer de suivre les évolutions internationales connues dans la fiscalité internationale.
