 هدف الدعوى الدستورية وسلطات القاضي في ظلها ونتائجها وحجيتها تضفي عليها الطبيعة العينية من دون ريبة. ولكن شرط المصلحة قد يبدو ظاهرا انه يحول مسارها تلقاء طبيعتها الشخصية. وان مما لا شك فيه أن أعمال الشرط أولى من إهماله، وحينها لا مناص من التقييد بشرط المصلحة الذي أوجبته المشرع بوصفه شرطا لقبول الدعوى، بيد أن هذا الشرط له مدلولات متعددة، ومتغيرة بحسب آلية تحريك الدعوى الدستورية.  ويرتكز قيام المصلحة على تحقق عنصر القانونية ومضمونه أن تضمن النصوص الدستورية، فضلا عن التشريعية، المراكز القانونية للأشخاص كافة، وتكون تلك الضمانة عصية على التعدي، كما تمكن الأفراد من اللوذ بالرقابة على دستورية القوانين. وتعد الدعوى الدستورية من أهم وسائل حماية الحق وهي الوسيلة التي خولها القانون لصاحب الحق في الالتجاء إلى القضاء لتقرير حقه أو حمايته وهي من وسائل حماية الحق ومن أهم وأكفل تلك الوسائل في حماية حقوق الأفراد لما لها من طابع عام ويمنح الحق لكل الأفراد أن يلجئ إليها في جميع الحالات التي يتعدى على حقوقهم ويجب أن تتوافر فيها شروط حتى يمكن قبولها والمصلحة هي من أهم تلك الشروط.
                  The objective of the Constitutional case and the power of the Judge in light of it , it is results and it is arguments give it the in-kind nature without doubt.  And so that the work of the Condition of First neglect, and then there is no need to restrict the requirement of interest which was imposed by the legislator as a condition to accept the lawsuit, However, this Condition has multiple implication and varies according to the mechanism of triggering the Constitution Case.  The establishment of the Authority is based on the realization of the legal element and it is content that the Constitutional texts, as well as the legislative, guarantee the legal status of all persons. Such guarantee is in surmountable whenever individuals can Control the Constitutionality of laws.  The Constitutional case is one of the most important mean of protecting the right, which is the mean given by the law to the right holder to resort to the to the Judiciary to determine his right or protectt him , It is the most important and guaranteed mints to protect the rights and guaranteed mints to protect the rights of individuals because of their general nature and gives the right to all individuals to resort to it in all Cases that infringe their rights. And wants to have Condition to be accepted and interest is one of the most important Conditions.
