 يتأثّر تطبيق قواعد المنافسة وقواعد حماية المستهلك في الجزائر وفرنسا على حدّ سواء بالخصائص الفريدة المميّزة لسوق المنتجات الصيدلانية، وهذا ما خلصت إليه هذه الورقة من خلال تسليطها الضوء على الكيفية التي يتم بها ضبط” المنافسة الصيدلانية” للأدوية الجنيسة لاسيما في السوق الفرنسية مع الإشارة إلى السوق الجزائري، وهذا في ظل الدور الحاسم الذي تضطلع به سلطات المنافسة في كلا البلدين للتصدّي للممارسات المقيّدة والمنافية للمنافسة وممارسات التشويه التجاري لسمعة الأدوية الجنيسة بغرض منعها الدخولَ إلى السوق. الأمر الذي يتّضح عبر تحليل قرارات وآراء سلطة المنافسة وبعض الأحكام القضائية في هذا الشأن.
The application of competition and consumer protection rules in both Algeria and France is influenced by the unique characteristics of the pharmaceutical market. This is what this paper concluded by highlighting how "pharmaceutical competition" is regulated for generic drugs, especially in the French market, with alluding to Algerian market. This is in light of the crucial role played by the competition authorities of both countries to fight against restrictive and anti-competitive practices and commercial denigration of the reputation of generic medicines with a view to preventing them from entering the market.  This is evident through the analysis of the competition authority's opinions decisions and some jurisprudence in this context.
