Abstract:

 وقوع هيئات الضمان الاجتماعي في عجز مالي بسبب ارتفاع تكاليف التغطية الاجتماعية الواسعة والشاملة للمؤمن لهم وذوي حقوقهم، لكفاية متطلبات التغطية الاجتماعية على حساب حجم الإيرادات، هذه الوضعية المالية مست بالتوازن المالي لصناديق الضمان الاجتماعي، كما أن استمرارها على المدى القصير أو المتوسط من شأنه الإضرار بحجم وجودة متطلبات التغطية الاجتماعية، وهو ما يدعو بإلحاح السلطات العمومية والممارسين والباحثين والمنظمات المهنية على حد سواء إلى التفكير بجدية لإيجاد حلول عملية لإشكالية عدم التوازن المالي لصناديق الضمان الاجتماعي. 
من هنا ظهرت الحاجة إلى البحث عن مصادر جديدة لتمويل صناديق الضمان الاجتماعي لمواجهة تحديات التغطية الاجتماعية الواسعة والشاملة، فلمعالجة هذه الإشكالية، برأينا، يقتضي قراءة جديدة لمنظومة التأمينات الاجتماعية بشكل شامل، لاسيما الطبيعة القانونية لصناديق الضمان الاجتماعي وصلاحياتها ومصادر تمويلها المختلفة.
يمكن اختزال القراءة الشاملة لمنظومة التأمينات الاجتماعية في الجزائر في محورين، هما: الاشتراكات كمصدر أساسي لتمويل نفقات الضمان الاجتماعي، فرص نجاح الاستثمار كمصدر مالي بديل لتمويل نفقات الضمان الاجتماعي.
Social security funds fall into a financial deficit because of the high costs of broad and comprehensive social coverage for their insureds and their beneficiaries, for the adequacy of social coverage requirements to the detriment of the volume of income.
This financial situation will affect the financial equilibrium of social security funds, and its short-term sustainability will affect the volume and quality of social coverage, which urgently calls for us, in collaboration with the public authorities, practitioners, researchers and professional organizations to intervene seriously and reflect, in order to find real and practical solutions to the major problem of the financial imbalance of social security funds.
 To this end, the search for new sources of funding for social security funds has become a necessity in order to meet the challenges of broad and comprehensive social coverage.
To respond to this problem, in my opinion, we need a new legal reading of the social insurance system as a whole, in particular the legal nature of social security funds, their powers and their different sources of funding.
The overall reading of the social security system in Algeria can be reduced to two axes: contributions as the main source of financing social security expenditure, and opportunities for investment success as an alternative financial source for financing social security expenditure. .
