Abstract:

The subject of this study is the criminal responsibility in the provisions of Romanian law by indicating the general rules of responsibility where the elements of the crime were identified from a material element and a moral element.
On the material side, it is well established that the Roman law has begun with the substantive responsibility, so that the material element is the basis of criminalization, since it was sufficient to do so even if he was inadvertently responsible.
On the moral side, the jurisprudence has begun in attempts to determine how the intent of the criminal acts is to be invoked, not only that, but many terms have appeared.
In this study, the following points were noted:
First, the Romanian criminal law did not seek to set definitions for many terms. This was a reason for its flexibility in many situations to confront many criminal phenomena, such as the crimes of violence and assault on the state property.
It can be said that the Egyptian criminal legislator was similar to this situation in the face of terrorism. Although it is defined as terrorist crimes, it has embraced the broad standard so that it can face many new acts and methods.
Second, the Roman legislator has punished for many acts which are legitimate. It has even led to the criminalization of acts such as the preparatory acts, given their gravity, even if the individual did not initiate their execution.
This has been partially applied by the criminal law, since the criminal acts have been criminalized, even if they do not amount to the punishment for the preparatory work.
