Abstract:

In this article, the new legal institution of the supplement to the judgment is examined carefully. This institute has definitely brought some advantages. But at the same time new problems have emerged. With this essay we try to name the problems and suggest solutions. The first decisions of the Higher Regional Court in particular are dealt with critically. Supplement to the judgment is a method that can be used against final decisions, regardless of whether it is procedural or substantive. In our opinion, it is possible to apply for the supplement to the judgment in terms of temporary legal protection requests. It should be noted that the completion of the provision is not an institution intended for the correction of mistakes in the judgment. Material mistakes made in the judgment can be resolved within the framework of Art. 304 of Turkish Civil Procedure Law; for other mistakes, it will be necessary to resort to legal remedies.
