Abstract:
The most important argument that prevailed in legal jurisprudence, and its fire has not been extinguished until today in the field of contracts, is the one whose topic was focused on the nature of the gradual relationship between justice and contract, which is explained by the principle of causation and determinism, where was and is still the scope of theorizing between two currents, one of them He has a belief represented in considering the contract as a realistic necessity, linked to the achievement of economic benefit, and as a legal means by which justice is achieved. Its legal stature does not exist without justice, which is a moral garment, the cloth of which is the legal text, woven and sewn with the needle of justice.
