 الزواج عقد إنساني فمن خلاله تحافظ البشرية على بقائها واستمراريتها بطريقة منظمة، ونظرا لأهميته فقد عملت كل التشريعات على تنظيم احكامه وبيان شروطه وأركانه خاصة الدولة الاسلامية التي يحتل فيها عقد الزواج مكانة مقدسة بين افراد مجتمعه
غير أنه في كثير من الاحيان يعترض الهدف من الزواج عدة إشكاليات تتعلق بأحد الزوجين فتحول دون تحقيق أهدافه الإنسانية مما يدفع بالتفكير إلى اللجوء الوسائل الحديثة للإنجاب والمعروفة بالتلقيح الاصطناعي والذي يعد حلا في غاية الاهمية يضمن في كثير من الاحيان استمرار العلاقة الزوجية، وتعد الزوجة الحلقة الاضعف في هذه العملية نظرا لأنها تعد موضوع التلقيح الاصطناعي الامر الذي قد يؤثر على مطاق حمايتها سواء على مستوي قانون الاسرة أو قانون لعقوبات.

Marriage is a human contract through which humanity assures preservation and continuity in an orderly manner, and given its importance of, all laws worked on the organization of its provisions and the clarification of its conditions, particularly, the Islamic State where marriage occupies a sacred place among the members of society.
However, the objective of marriage often faces several problems related to one of the spouses, preventing it from achieving his humanitarian goals, which leads to think of modern means of reproduction known as artificial insemination, which is a very important solution that often guarantees the continuation of the marital relationship. The wife is the most vulnerable part in this process because she is considered as the subject of artificial insemination and that may affect the scope of her protection, both in the Family Law or the Penal Code.
