Abstract:

 There are some acts which the Algerian Ligistlator does not take into consideration interms of criminilizing them in punitive texts, with respect to the family crimes. This later can be considered as a legal vacum.One of the most important issues that are not criminilized is the non respect of the established measures in case of artificial insemination surgery and its effects on family ties with regard to the Mixing Genealogy , unlike some other Maghrebian ligistlations that criminilized it.and thus requires the Algerian ligistlator to tackle these intersting issues within the comparison laws ; concerning how to adopt the abuses and to what extent the penal protection can be achieved among the unfair  behaivior happened .
                  هناك بعض الأفعال التي غفل المشرع الجزائي الجزائري عن تجريمها في نصوص عقابية فيما يتعلق بجرائم الأسرة، مما يمكن إعتباره على أنه فراغ قانوني، نذكر من أهم هذه المسائل عدم تجريم حالة الخروج عن الضوابط المقررة في القيام بعملية التلقيح الإصطناعي وما لذلك من أثر فيما يتعلق بإختلاط  الأنساب، وبالتالي المساس بالروابط الأسرية على خلاف بعض التشريعات المغاربية الأخرى التي جرمتها، مما يقتضى معه الأمر إلى وجوب النظر في معالجة هذه المسائل ضمن القوانين المقارنة فيما يتعلق بإيجاد التكييف الأنسب لهذه التجاوزات وما مدى تحقيق الحماية الجزائية للرابطة الأسرية ضمن صور السلوك الحاصل.
