Abstract:

The subject of this study is to examine neo-liberal discourse that claim social state has lost its social approval and entered into a legitimacy crisis by relying on empirical research findings. Legal legitimacy in the sense of compliance with legal norms and socio-political legitimacy implying the approval by majority of the society are two main components of the notion of legitimacy complementing each other. Since the State is defined as a democratic, social state where by social rights are safeguarded together with the fundamental rights and freedoms in all modern constitutions, there is no need for proposals for the amendments of relevant provisions of the constitutions, nor is there doubt for legitimacy. On the other hand, as the empirical research findings support that the social state model have strong social acceptance in all European Countries, contrary to the neo-liberal discourse, there is no room for a debate on the socio-politic legitimacy of social state. Instead what is deprived of legitimacy is the neoliberal discourse itself, that tends to be entirely ideologic by neglecting the will of majority of population as well as legal norms and lacking sound empiric proofs.
