Abstract:

Will/Testament is a verbal or written statement of someone’s wishes to be carried out after his death. The document in which the will is written down is called testament or the letter of testament. The Prophet Muhammed (pbuh) advised Muslims to prepare their wills while they were alive and also emphasized to consider rights of heirs. In the historical process, in Islamic social life; a tradition of writing testament has been formed with conditions such as having been two fair witnesses, abiding by the religious rules, not harming to the heirs, protecting kinship rights and specifying the person debts that has to be paid for the rights of human or God. As it is known, Bosnia State was under the dominacation of Ottoman Empire (1300-1922) that had the largest territory almost 24 million km2. Bosnia and Herzegovina remained under Ottoman rule nearly 300 years between 1580-1878. During that period, there was a great intense acculturation between these two cultures that still exists today. This acculturation developed in the common denominator of Islam, had been reflections from administration to economics, from science to art, from commercial life to social life. As a result of this acculturation, customs and traditions; from eating-drinking to production-consumption, from worshiping to entertainment, from birth to death that shape daily life in the region, were blended. Thus, death and things that would be done before and after death and preparing a will in the meantime were the customs in this interaction. Testaments are important documents that give ideas about daily life. Sokolovic Hüseyin Agha’s testament that will be discussed in this study, had been written in Turkish, although it was written almost 70 years after the Ottoman rulery. This study aims to rewrite the document in question and to make its transliteration and to evaluate it based on the information given between the lines.
