Abstract:

In this article, the probation institution, which originated centuries ago, and had the opportunity to apply with many different names, and reformed the criminals to become an individual of the modern world, is discussed. The probation institution was in practice in the form of postponing a prison sentence that was previously imposed on the person, but in time this method became a participant of the offender in the correctional programs, adapting to the society and examining the movements under the supervision of the persons in charge. The incorporation of probation into our legal system was achieved through the regulations made in 2005. With the introduction of the Turkish Legal System, it was aimed to reduce these numbers with temporary substances in order to reduce the current density in prisons as soon as possible, but unfortunately, many convicts who did not complete their rehabilitation programs and did not reveal their good condition were released. For this reason, such wrong practices have led to the perception of probation as forgiveness before society. In order to prevent this misunderstanding, only those who will demonstrate their good condition should benefit from the probation institution. Here, in a way, the state guarantees the criminal and the steps to be taken in this respect must be determined correctly.
