 تعتبر السيادة الفلسطينية على القدس بمكوناتها الأساسية المتوارثة منذ القدم وبصورة مستمرة الحق الثابت للشعب الفلسطيني، والتي ظلت ولا تزال موقوفة على الشعب الفلسطيني وحده، غير أن إسرائيل تسعى باستمرار إلى تغييب السيادة الفلسطينية على القدس وحجبها بسلطة مزعومة وغير مشروعة، مستندة إلى ادعاءات مخالفة للشرعية الدولية وأحكام القانون الدولي. كما أن احتلال إسرائيل وضمها للمدينة المقدسة لا يرتب أي حقوقا وأثار على حق السيادة الأصلي للشعب الفلسطيني، لان الاحتلال لا يخول بنقل السيادة على القدس إلى الدولة المحتلة. إن القرار الأمريكي بالاعتراف بالقدس عاصمة لإسرائيل يعد مخالفا للشرعية الدولية، ومخالفا لقرار التقسيم رقم 181 لعام 1947، القاضي بمنح القدس وضعا قانونيا خاصا تحت وصاية الأمم المتحدة، ومخالف لاتفاقية أوسلو. ويشكل موضوع مستقبل القدس واحدا من أهم المواضيع في مفاوضات الحل النهائي، ولقد قدمت عدة مقترحات خاصة بحل مشكلة القدس واهم هذه المقترحات هو تدويل المدينة بناءا على قرار التقسيم، ومقترح العاصمة المزدوجة، والحل الديني والجغرافي.
                  The Palestiniansovereignty over Jerusalem, withits basic components inheritedfromancient times and continuously, is the inalienable right of the Palestinian people, which has remained and isstill in the hands of the Palestinian people alone. However, Israelconstantlyseeks the absence of Palestiniansovereignty over Jerusalem and itsdenial of an alleged and illegitimateauthority, And the provisions of international law. Israel's occupation and annexation of the Holy City does not have anyrights or effects on the original sovereignty of the Palestinian people, because the occupation does not authorize the transfer of sovereignty over Jerusalem to the occupied state. The United States' decision to recognizeJerusalem as the capital of Israeliscontrary to international legitimacy, and contrary to partition resolution 181 of 1947, whichgrantsJerusalem a speciallegalstatusunder United Nations tutelage, contrary to the Oslo agreement. The most important of theseproposalsis the internationalization of the city based on the partition decision, the proposal of the dual capital, and the religious and geographical solution.
