 وهذا البحث يحتوي على مقدمة بينت فيها أن العقوبة هي رد الفعل الطبيعي للجريمة سواء في المجال التأديبي أو الجنائي: في المبحث الأول: تناولت تعريف العقوبة التأديبية. وذكرت أن الفقهاء وشراح القانون لم يتوصلوا بعد إلى تعريف العقوبة سواء في مصر أو اليمن. وقد عرفت العقوبة من منطلق أنها إيلام وإيذاء للمتهم سواء من الناحية الأدبية أو الاقتصادية، ثم عرضت لأوجه الاتفاق والاختلاف بين العقوبة في المجال الجنائي والتأديبي، وبعد ذلك عرضت لشروط توقيع العقوبة التأديبية على الموظف العام. وكل ذلك من منطلق أن العقوبة لابد وأن تكون متناسبة مع الجزاء. وفى المبحث الثاني تعرضت لأنواع العقوبة الموقعة على الموظف العام سواء كانت مالية أو أدبية مع ذكر وجهة نظري في بعض هذه العقوبات وأثرها من الناحيتين الأدبية والاقتصادية وكل ذلك في مصر من خلال نص المادة (80) من القانون رقم 47 لسنة 1978 والخاص بالعاملين المدنيين بالدولة وفى اليمن من خلال قانون الخدمة المدنية اليمنى الجديد رقم 19 لسنة ١٩٩١ بناء على نص المادة (111) من هذا القانون بالرغم أن بعض العقوبات المنصوص عليها في مصر غير منصوص عليها في القانون اليمنى. وفى المبحث الثالث: تناولت شخصية العقوبة والقصود بذلك والأصل الذي يقوم علبه مبدأ شخصية العقوبة والاستثناءات الواردة على هذا المبدأ. ثم خاتمة البحث والنتائج والمراجع والفهرس.
                  This research contains a preface that i illustrated in it the idea of penalty or sanction is logically a rection for natural action of the crime whatever in disciplinary or criminal fieds : In the first rhem: I dealt with the definition of moral sanction. Also, I mentioned that the scholars, jurists and law explainers haven’t reached yet to the accurate definition wherever in Egypt or yemen. So, My definition for the sanction or penalty based on that it is as a pain or a torment which the accused faces and live in it whatever a moral ethical or economic preview, then discussed the similarities and differences aspects between the penalty in the criminal or ethical fields, after that, dealt with the conditions of setting the ethical penalty for the common governmental employee. All of that comes from the conception of the pain should suitable for and matches with the crime and its pinishment. In the second them : I dealt with the pains kinds which submitted on the governmental employee whatever it was a financial or ethical one with mentioning my point of view for some of these penalties and its affects on both aspects the ethical and economical one, and all of that existed in Egypt by the article text No. (80) from the act No. (47) in the year 1978 which set for the civil labors in the country and in yemen which taken from the new yemen civil services law No. (19) in the year 1991 according to the article text No. (111) from this although that there are some pains written down in Egypt and not in Yemen . In the third theme: I dealt with the personality of the pain and what it aimed at and the source which the personality of pain built on it and the mentioned expections related to this principle. After that in order, the research conclusdion, results, references and index.
