 This study was conducted to examine the files decided in the Supreme Court as a result of the lawsuits filed against nurses due to medical malpractice. Material and Method: In this study, using the qualitative document analysis method, the supreme Court appeal decision files concluded by the Supreme Court in the last six were examined. As a result of the review of the files from 2018 to 2023, they were identified 30 Supreme Court Files. Files were recorded in the data collection form which developed by the researchers. The data collection form includes 13 questions regarding case type, court decision, and medical errors. The data obtained were evaluated with descriptive statistical analysis methods. Results: It was observed that there were 30 cases reported to the Supreme Court between 2018 and 2023. When the areas of medical error are examined; It was seen that the most files were for intramuscular drug applications 66.6. It was observed that this was followed by 2 cases in the field of communication errors. When the damages experienced were examined; It was observed that the most common causes were pain in the leg, loss of sensation, and difficulty in walking 56.6, followed by death 26.6 and burn cases 1 case in the third place. When the Supreme Court decisions are examined; It was observed that 80 of the cases resulted in acquittal and 16.6 resulted in a decision to confirm the crime. Conclusion: It is essential to identify areas of complaint and error for nurses and take the necessary precautions.

 Bu araştırmada, hemşirelere yönelik tıbbi uygulama hataları nedeniyle açılan davalar sonucunda yargıtayda karara bağlanan dosyaların incelenmesi amaçlanmıştır. Materyal ve Metod: Niteliksel doküman analizi yöntemi ile yapılan çalışmada T.C. Yargıtay Başkanlığı resmi internet sitesi üzerinden, hemşire, tıbbi uygulama hatası, tıbbi hata anahtar kelimeleri kullanılarak, geriye dönük son 6 yılda yargıtay makamınca karara bağlanmış, yargıtay temyiz karar dosyaları incelenmiştir. Araştırmacılar tarafından 2018-2023 tarihleri arasındaki dosyaların taranması sonunda, 30 adet yargıtay kararına ulaşılmıştır. Veri toplama formunda; dava türü, mahkeme kararı ve tıbbi hatalara ilişkin 13 soru bulunmaktadır. Elde edilen veriler tanımlayıcı istatistiksel analiz yöntemleri ile değerlendirildi. Bulgular: 2018-2023 yılları arasında yargıtaya yansımış 30 dosya olduğu görüldü. Tıbbi hata alanları incelendiğinde; en çok intra musküler ilaç uygulamalarına yönelik 66.6 dosya olduğu görüldü. Bunu, iletişim hataları alanında 2 olgunun izlediği olduğu görüldü. Yaşanan zararlar incelendiğinde; en çok bacakta ağrı, his kaybı ve yürümede zorluk 56,6, ikinci sırada ölüm 26,6, üçüncü sırada ise yanık vakasının 1olgu olduğu görüldü. Yargıtay kararları incelendiğinde; davaların 80i beraat, 16.6sı ise suçun onanması kararı ile sonuçlandığı görüldü. Sonuç: Hemşirelere yönelik şikayet ve hata alanlarının belirlenerek buna yönelik önlemlerin alınması çok önemlidir.
