يتلخص بحث (العيب الذي يثبت به الخيار في البيع) في النتائج التالية:
اتفق أهل العلم على أن المشتري إذا اطّلع في المبيع على عيب سابق للعقد ولم يكن عالما به أن له الخيار بين الرد والإمساك.
اختلف أهل العلم في حد العيب الذي يثبت به الخيار على أقوال أرجحها عندي أن العيب هو: (كلُّ ما يُنقص القيمةَ، أو يُنقصُ العينَ نقصاً يَفوتُ به على العاقد غرضٌ صحيحٌ، إذا غلب في جنس المبيع عدمه).
كل ما ينقص القيمة يعد عيباً يثبت به الخيار مالم يكن النقص معتاداً.
نقص العين المعقود عليها إذا لم ينقص القيمة لا يعد عيباً يثبت به الرد إلا إذا فات به على العاقد غرض صحيح وكان الغالب السلامة منه.
لا يلزم من كون النقص في الثمن أو العين عيبا أن يثبت به خيار الرد، فإن الرد لابد له من توفر الشروط التي يذكرها الفقهاء لثبوت خيار العيب، من مثل تقدمه على العقد، وعدم رضا المشتري به وغيرها مما بسطه الفقهاء عند الحديث عن خيار العيب.

 The research (The fault with which option is proven) is summarized in the following results:

The scholars unanimously agreed that if the buyer discovered a pre-contracting fault in the sold property and was not cognizant with it, he will be at option to accept or partake.
The scholars disagreed in the limit of the fault with which the option, according to the preferred opinion, is proven that the fault is “ all that depreciates or decrease the value of the property that renders the contracting party to miss valid purpose, if the majority of the kind of the sold property lacked it(.
All that depreciates or decreases the value shall be a fault with which the option is proven, unless this fault is usual.
Insufficiency of the contracted property that does not decrease the value shall not be considered as fault with which the return is proven unless it made the contracting part miss correct or valid purpose, but it was mostly free from it.
