 ملخص:
تهدف هذه الورقة البحثية إلى التعريف بموضوع فقهي قانوني مهّم، في بناء ونشأت الفرد أثناء قيام العلاقة الزوجية و بعد انحلالها، وهو الإبراء من الحضانة للشخص الذي اسند له الحق في حضانة الطفل الصغير و رعاية وتعليمه والقيام بتربيته و السهر على حمايته و حفظه صحة وخلقا.
إلا انه تطرأ على الحاضن أسباب قد تكون عائق يحول دون تحقيق مصلحة المحضون، فيبرأ الحاضن من حقه في الحضانة إلى شخص أخر تكمن فيه الصفات التي من شانها حماية حق المحضون .
 
Abstract:

 However, reasons may occur to the fosterer, which may be an obstacle to achieving the interest of the child The fosterer is absolved of his 
 .right to custod to another person in whom there are characteristics that would protect the right of the child.
