Abstract:

Labor union right and freedom are among the fundamental rights and freedoms, and workers who organize under the roof of a union with the use of this right overcome the economic power imbalance against the employer by signing a collective bargaining agreement. Since the collective bargaining agreement is a contract concluded as a result of the workers negotiating their rights and working conditions with their employers, it becomes an essential tool that enables workers to be in a stronger position against their employers and to obtain better working conditions, wages and other advantages. As a rule, only workers who are members of the labor union, which is a party to the contract, can benefit from the monetary rights and opportunities determined by the collective bargaining agreement. On the other hand, freedom of trade union guarantees individuals to be members of any union they wish, as well as the freedom of not being a member of any union. Due to the negative trade union freedom being guaranteed, the legislator did not offer the opportunity to benefit from the collective bargaining agreement only to the workers who are members of the party union. In addition, there may be workers who cannot benefit from the collective bargaining agreement. These persons cannot benefit from the contract even if the party is a member of a labor union. In our study, the content of the collective bargaining agreement and the application area of the collective bargaining agreement will be briefly mentioned. The institution of benefiting from the collective bargaining agreement will be examined by making a dual distinction in terms of workers who are members of the party labor union and workers who are not members of the union.
