Abstract:

Tort liability is a fundamental source of obligations in civil law, founded on the principle of non-harm and aimed at restoring social balance whenever an unlawful act results in damage requiring compensation. This system is built upon three essential elements: fault, damage, and causation. Fault constitutes the most significant element due to its varying forms and degrees, ranging from slight fault to gross negligence, and culminating in intentional fault, which is characterized by deliberate conduct and awareness of its consequences. Intentional fault has long been the subject of doctrinal and legal debate regarding its nature: whether it should be treated as a mere aggravated form of fault or as a distinct category with specific legal implications. It also raises questions concerning its relationship with criminal intent and its impact on the structure of tort liability. The study gains particular importance in the Libyan legal context, where—unlike several comparative legal systems—no distinction is made between intentional and unintentional fault, necessitating an examination of its effects within the domains of compensation and civil evidence.
