Abstract:

"The study discusses the problem of violating digital privacy, as a threat to the interests of the individual and the state at the same time, as all the personal data and information and the digital content of the accounts and sites under the risks of modern technology are dangerous, and accordingly the definition of privacy and digital privacy and difficulties facing data and information in the digital community were addressed. In the end, legal mechanisms to protect digital privacy in the French, American and Egyptian legal systems were clarified and the mechanisms of self-protection of the privacy settings were also clarified. By the end of this study we found that, development in information and communication systems and the development of Smart Digital Devices and Internet assist on a large scale to endanger the violation and threats to personal and private information of individuals and states, which may indicate that these systems and mechanisms that were not used in spying on individuals and States are helping it, which poses a danger to States and their citizens. This danger compels states to understand this new society and educate its citizens To protect personal data and private information. In the absence of a special and comprehensive legislative system for the protection of digital privacy from all legal and technical aspects, it is inconceivable that the digital community is the space that absorbs our privacy, especially with the digital society's goals opposing communication, profitability and surveillance. Because of digital illiteracy of countries and users, who deal with the digital society is a community of entertainment, we suggest the following: 1- Necessity of awaring and educating social networking sites’ users with the Right of Privacy and protect their personal data and information by reviewing privacy settings and terms of use. 2- To establish a comprehensive legal and technical system for all aspects of digital society, and to the extent appropriate with the new media system based on modern technology and information systems and social networking sites, as the threats of digital privacy is not penetration of individuals within the state, but is a breakthrough and spy on the state, which threatens the stability and security. 3- The need for agreements with countries and coordination with the social networking sites to have a double check on Privacy Policy, Terms of Use and general conditions to create accounts, to enact national legislations for registering and collecting personal data, how to use it and disclose it to everyone, whether public or private to prevent the existence of unidentified identities as a great threat to digital privacy and to ensure the privacy of individuals taking in consideration Legitimate interests of States. 4- The need for the state to adopt a self-regulating system to protect the privacy or assign the specialized sectors in the state to develop internal self-regulating system to protect personal data for citizens and charging maximum protection for data endangering the state. 5- Necessity to establish specialized agencies to protect digital privacy and to encounter crimes related to information technology also to allocate judicial divisions for information crimes.".
