 يعد التشرد وفق المادة 196 من قانون العقوبات الجزائري جنحة عقوبتها الحبس من شهر إلى ستة أشهر من صدر هذا الفعل عن شخص راشد ومسؤول جنائيا لأن الطفل الذي يرتكب إحدى الجرائم معاقب عليها بمقتضى نصوص قانون العقوبات إنما يعد جاني وليس مجرما. ولا توقع على مثل هذا الطفل وفق ما هو منصوص عليه في المادة 49 من قانون العقوبات إلا تدابير الحماية والتربية. ومع ذلك فإنه في مواد المخالفات لا يكون محلا إلا للتوبيخ، كما صرحت نفس المادة على أنه تتخذ ضد القاصر الذي يبلغ سنة ما بين 13 و18 سنة إلا تدابير الحماية أو التربية أو عقوبات مخففة.  انطلاقا من النصوص السابقة قد نتساءل عن كيفية تفاعل المشرع الجزائري مع الطفل الذي جعل من الشارع مأوى له؟  وعلى اعتباره طفلا في خطر أم تعامل معه على أساس أنه حدث جانح. تقتضي الإجابة عن هذا السؤال الرجوع إلى نصوص قانون العقوبات دائما، والذي نص صراحة في المادة 196 مكرر منه على أنه فيما يخص المخالفات المنصوص عليها في المادتين المذكورتين أعلاه لا يتخذ ضد الأحداث الذين لم يبلغوا الثامنة عشر إلا تدابير الحماية والتهذيب.  إن الوقوف عند النص المذكور آنفا لا يسعفنا الإجابة عن السؤال مطروح أعلاه، لأن تدابير الحماية يمكن اتخاذها في مواجهة الطفل الجانح على غرار الطفل الذي هو في خطر مع بعض الاختلاف سبب وجود بعض التدابير الخاصة بالأطفال الذين هم في خطر والتي جاء التي عليها بمقتضى قانون حماية الطفولة المراهقة.  إلا أنه بالنظر إلى جميع النصوص المذكورة أعلاه يمكننا وصف ((طفل الشارع على أنه حالة خاصة، لأنه يمكن النظر إليه على أنه جانح وفي خطر في نفس الوقت، مما يستدعي حمايته ومعاملته معاملة خاصة، تضمن إعادة تأهيله ووقايته من حياة التشرد والانحراف وهذا ما سنقف عليه في هذا البحث.
                  In accordance with Article 196 of the Algerian Penal Code, homelessness is considered a misdemeanor punishable by one to six months imprisonment when committed by an adult person and criminally responsible .Because a child who commits a crime punishable under the Penal Code is a delinquent but not a criminal. Such a child ،according to what is stipulated in Article 49 of the Penal Code is subject to discipline and protection measures. However ،according to the same Irregularities Code ،the child is subject to reprimand ،whereas the same Article states that should be taken some education and protection measures or reduced sentences against the minor delinquent whoreached the age of between 13 and 18 years old. From the texts mentioned above ،one may wonder how did the Algerian Legislator handle the case of a child who has taken the street as his shelter .Is he a child at risk or a juvenile offender? To answer this question ،one should refer to the provisions of the Penal Code which explicitly state in Article 196 bis “With respect to the violations stipulated in the articles mentioned above،” “are not taken against juveniles who have not attained eighteen ،only protection and discipline measures. ”However ،relying on the above texts ،one can consider “the street child” a special case because he is a juvenile offender and a juvenile at risk which calls for protection and special treatment to ensure rehabilitation and prevention
