Abstract:

Kur’an ve Sünnet’te yer alan yasaklardan biri faizdir.

One of the prohibitions in the Qur'an Al-Kareem and Sunnah is interest. Islam blocked the reasons that lead to interest in two ways. From the point of view of the lender with interest, the Prophet (pbuh) forbade one from taking a profit that is not remunerated, from selling something one did not receive, from selling something one does not have with him, and from conducting the sale of al-kali bil-kali. Because each of these issues creates interest for the creditor.Just as it is considered forbidden (haram) for the creditor to have interest, even if it is a third party, in contracts with reciprocal costs, it is also forbidden (haram) for the debtor to give interest in such transactions, even if it is a third party. This is because Islam forbids taking or giving interest without any exclusion in this regard.Modern Islamic jurists (Ulama of Fıqh) have considered the issues knowing these provisions while discussing the rules of the murabahah transaction, which gives the purchase order. Based on this, they stated have that in the murabahah transaction, a bank must own the goods subject to the murabahah and that it must undertake the indemnification responsibility of the related goods before selling it to the customer on a credit basis. If the goods subject to the murabahah transactions is sold beforehand to the customer requesting financing, a bank will have sold a goods that it does not have or will have sold the debt. These transactions are of the ones which contain interest according to Islamic law (Fıqh).
The prohibition of interest on the part of the debtor has two forms in Islamic law, one specific and the other general. The specific form occurred in the form of the prohibition of the sale and buyback transaction (inah). The general form points to the rules of shariah regarding the protection of goods. The interest is of great persecutions, and the eating of people's goods in a way unfairly. Based on this principle, Islamic banks have emerged to operate the interest-free system in a way that will eliminate this injustice and oppression. Those who took the responsibility of these banks tried to develop alternatives to the interest system in accordance with the rules and principles of Islamic law and to meet the needs of people by avoiding interest. The Islamic finance sector, which served on the basis of labor-capital partnership (mudarabah) and murabahah (adding profit), when it first emerged, has carried out studies to introduce new interest-free finance products in the following years and the developing conjuncture. Salam and istisnā‘ contracts, which are widely used in classical fıqh, and sukūk issues based on murabahah, icāra (lease) and mudarabah are some of the interest-free finance products studied at the point of Islamic banking. In addition, studies have started to offer an interest-free model under the name of takāful in Islamic finance, not only in the field of banking but also in the field of insurance. In parallel with the emerging developments the funding formulas provided by these institutions to their customers have also improved. One of these formulas is tawarruq product, which is considered to be a successful way to meet the cash need. This transaction has become widespread among Islamic Banking transactions over time, so tawarruq has become the main financial product in some countries' Islamic banks’ financial transactions in terms of transaction capacity. Therefore, it was necessary to shed light on the process of bank tawarruq in order to understand the impact and provision of it on Islamic Finance’s future and to know the economic aspect of other funding forms. The tawarruq is one of the issues that causes discussing between jurists and economists who interested in Islamic banking sector in Turkey, following the standard issued by the PBAT Advisory Board. The issue is an important issue as it brings closer financial institutions that are accustomed to tawarruq, especially Islamic banks, to traditional banking financing practices. In this study, firstly, the conceptual framework of the tawarruq transaction is analysed. Afterwards, the connection of bank tawarruq with the sale and buyback was examined in the context of terminological meaning. Then, the types of tawarruq was examined and the subject has been examined by comparing it with the subjects of sadd al-zarāi‘ and hiyal. At the end of the study, the AAOIFI Standard and the tawarruq standard which published by the PBAT Central Advisory Board were examined in detail. Afterwards, an evaluation was made for both standards.
