 ملخص:
يعتبر موضوع حماية الطفل المحضون من أهم المواضيع القانونية وأكثرها شيوعا على مستوى المحاكم، حيث وضع المشرع جملة من الضمانات تهدف إلى حماية مصلحة المحضون، إلاّ أن النصوص القانونية في حالة تطبيقها قد تصطدم بواقع اجتماعي صعب، وبالتالي فتح مجال أوسع للاجتهاد القضائي حتى يضع حلولا مناسبة ويسد الثغرات القانونية التي تكون محل جدل ونقاش، إعمالا بمبدأ حماية مصلحة المحضون بدرجة أولى. 
Abstract: 
The issue of protecting a child is one of the most important and most common legal issues at the courts level. The legislator has put in place a number of safeguards designed to protect the interests of the child. However, the legal texts may apply to a difficult social reality, thus opening up a wider area of jurisprudence to The legal gaps that are subject to debate and debate, in accordance with the principle of protecting the interests of the first-degree.
