Abstract:

The criminalization of travel for terrorist purposes, as provided for in article 87 bis 11 of the Algerian penal code, reflects the national legislator’s commitment to United Nations Security Council resolution No.2187, dated 24 September 2014.
This criminalization does not target the act of travel in itself, but rather the terrorist purpose associated with such travel. It thus confers a new dimension to the function of criminal law, which is no longer limited to deterrence and the imposition of penalties after the commission of an offense, but also aimed at addressing the preparatory stages of criminal acts before they occur, thus reinforcing the concept of prevention.
This raises the question of whether the legislator has successfully reconciled compliance with international obligations and adherence to the principle of legality in criminal law.
