 يتناول البحث الإشكالات القانونية التي تثيرها مسألة حماية وحفظ الأمن الإنساني لصعوبة التوفيق بين تنفيذ مسؤولية الحماية واحترام سيادة الدول وعدم التدخل في شؤونها الداخلية. ويهدف إلى تحليل الأساس القانوني لمسؤولية الحماية في نصوص المعاهدات والمواثيق الدولية، وكذا مستوياتها وسبل وآليات تنفيذها. كما يتناول البحث أيضا مسؤولية بعض أهم الأجهزة الدولية (مجلس الأمن، المحاكم الجنائية الدولية) في تقرير الجزاءات حينما يتعرض السلم والأمن الدوليين للإخلال جراء الانتهاكات الجسيمة لحقوق الإنسان سيما أثناء النزاعات المسلحة الداخلية، ومن ثمة تقديم أهم الاقتراحات لتجاوز تلك الإشكالات القانونية.
                  This research paper shed the light on the implementation of the responsibility to protect which suppose protecting and preserving human security and the respect of the state’s sovereignty and non-interference in their internal affairs. It aims to solve the legal problems by analyzing: First, the legal basis of the responsibility to protect in the international conventions and covenants. Then, the mechanisms for implementing the responsibility to protect for instance the Security Council and the international criminal court has a tremendous role in preventing and solving non-international armed conflicts and sanctioning widespread violation of human rights.
