Abstract:

The study aimed at identifying the formality of the transfer of ownership of the non-portfolio property in the form of ownership transfer of the property in the light of the study of jurisprudence and Moroccan judicial work. The study addressed several elements. The first element explained the formality of the transfer of ownership of the property held in netting contracts, including the effect of the restriction in the real estate fee and the authoritative restriction in the real estate fee. The second element discussed the formality of the transfer of ownership of the property held in the contribution contracts, through the recognition of the legal position required for the material possessor, considering that the restriction in the drawing property itself is not enough, and the judicial position limited to the restriction in the real estate fees. The study pointed out that the seller of the real estate is the owner of the property sold as long as the sale was not announced by registering it in the Land Registry. Consequently, he can do whatever he wants in this property, and if he did so and the new assigner to register his right, the rights of the first now are vulnerable to loss, so the buyer shall do the best to expedite, as far as possible, the registration of the property sold on his name in the Land Register. The study concluded that the transfer of the ownership of the real estate of the sold portfolio is made only from the time the real estate governor signs the real estate register after presenting summary data in it with the date.
