Abstract:

For more than two decades, humanitarian considerations have been a fundamental determinant of international policy and a pillar of the foreign policy of major Powers. To this effect, respect for human rights has also become one of the basic criteria for assisting developing countries, especially those that have suffered from war and conflict. In this respect, the importance of respecting human rights is evidenced by the increasing number of resolutions and recommendations issued by the United Nations (UN) related to human security, as well as by international organizations concerned with the field of human rights, especially since the intervention of the NATO in Kosovo in 1998. However, this intervention emphasized the conflict between the principle of international sovereignty, which is on the one hand a mainstay in the United Nations system and international law, and the renewed norms related to human rights and the use of force on the other.
