The improvement of the investment environment depends on the harmonious economy and legal fields. In this context, the provisions of the Enforcement and Bankruptcy Code regarding the institution of concordat which were inert have been activated by the Code numbered 7101. In accordance with the provisional article 14 added to the Enforcement and Bankruptcy Code by the article 46 of the Code numbered 7101, in places where there are three or fewer commercial courts the Commercial Court numbered (1), in places where there are more than three commercial courts the Commercial Courts (1), (2) and (3) are designated as competent specialized courts in the claims arising from the ordinary concordat by the Council of Judges and Prosecutors.
In this study, the legal nature of the relationship between the commercial courts which have jurisdiction on demands of the ordinary concordat and whether it is unconstitutional or not that the Council of Judges and Prosecutors makes a distribution among commercial courts of first instance in order to ensure specialization will be discussed. In addition, issues regarding procedure which may arise from the rules governing jurisdiction and the distribution of jurisdiction in concordat demands will be discussed and solutions are going to be proposed.

 

Yatırım ortamının iyileşmesi, ekonomi ve hukuk alanlarının birbiriyle uyumlu olmasına bağlıdır. Bu kapsamda, 7101 sayılı Kanun ile İcra ve İflâs Kanunu’nda atıl bir şekilde bulunan konkordato müessesesine ilişkin hükümler etkin hale getirilmiştir. 7101 sayılı Kanun’un 46. maddesiyle İcra ve İflâs Kanunu’na eklenen geçici 14. maddesine göre; Hâkimler ve Savcılar Kurulu tarafından adi konkordatodan kaynaklanan taleplerde; üç ve daha az asliye ticaret mahkemesi bulunan yerlerde (1) numaralı asliye ticaret mahkemesi, üçten fazla asliye ticaret mahkemesi bulunan yerlerde ise (1), (2) ve (3) numaralı asliye ticaret mahkemeleri ihtisas mahkemesi olarak belirlenmiştir. 
Bu çalışmamızda, adi konkordato taleplerine bakmakla görevli asliye ticaret mahkemelerinin daireleri arasındaki ilişkinin hukukî niteliği ile Hâkimler ve Savcılar Kurulu’nun asliye ticaret mahkemeleri arasında ihtisaslaşma olgusu ile bir dağılım yapmasının Anayasa’ya aykırı olup olmadığı konuları tartışılacaktır. Ayrıca konkordato taleplerinde görev kurallarına ve iş dağılımına bağlı olarak ortaya çıkabilecek usulî meseleler üzerinde durulacak ve bu meselelere çözüm önerilerinde bulunulacaktır.
