 الحمد لله وكفى، والصلاة والسلام على المبعوث رحمة للعالمين، وعلى آلة وصحبه أجمعين.  وبعد: فإن متن (زاد المستقنع في اختصار المقنع): هو من أشهر متون الفقه الحنبلي عند المتأخرين، وهو المتن الذي صار في دار الحنابلة (جزيرة العرب)، لاسيما الديار النجدية منها: أصلا في دراسة المذهب، ومفتاحا للطلب، فاشتغل به الناس قراءة، وإقراء، وحفظا، وتلقينا، وشرحا في حلق المشايخ في المساجد، وفي المعاهد النظامية، وفي بعض الجامعات الإسلامية بالمملكة العربية السعودية حاليا، حتى كان بعض العلماء يشرحه بفك العبارة فقط للمبتدئين، ويذكر الدليل للمتوسطين، ولمن بعدهم: يذكر الخلاف في المذهب، والخلاف العالي. ولم يؤلف بعده متن مشبع بالمسائل، والمهمات مثله، فضلا أن يفوقه في كثرتها واحتوائها-نصا ومنطوقا وإيحاء ومفهوما، ومع صغر حجمه حوى ما يغني عن التطويل في غالب مسائله الفقهية، وتطرق لإشارات الخلاف في المذهب الحنبلي وأبدع في استعمالاتها-رغم أنه لم ينص عليها نصا صريحا ولكنه أشار إليها، ونوع منها بحسب سياقاتها، مما جعلني أتتبعها لكي أصل إلى نتيجة في معرفة مدلولاتها عنده، وخاصة مراد أهل مذهبه منها. فقد كان الإمام ابن قدامة في كتابه "المقنع" يطلق قوله بالروايتين والوجهين في بعض الأحكام، ولكن الحجاوي رحمه الله-كان يختار ما يراه راجحا عنده، دون الإشارة إلى خلافه، أي دون الإشارة إلى الرواية الأخرى أو الوجه الآخر. ولذا قد لا ينتبه الباحث إلى هذه الطريقة فيظن أن الحجاوي لم يشر في "الزاد" إلى الخلاف في المذهب، والصحيح أنه أشار إليه في مواضع كثيرة جدا.  وهذا الذي سأبينه في بحثي هذا أن الحجاوي ذكر حروف الخلاف في المذهب الحنبلي، وذكر الخلاف أيضا بمصطلح علمي وهو " ظاهر المذهب" في مسألة واحدة فقط، وذكر الخلاف أيضا بأسلوب النفي، وبإفادات أخرى، كما سيتجلى مواقعها في هذا البحث إن شاء الله تعالى. فهذا الموضوع يحتاج إلى دراسة فقهية للمسائل التي استخدم فيها هذه الحروف، حتى نصل إلى نتيجة علمية قطعية -أو ظنية على الأقل-حول منهجه في استخدام "حروف الخلاف" ودلالة كل حرف منها. فقمت بدراسته في بحثي هذا لعل أكمل بعض النقص وأفيد فيه نفسي وإخواني طلاب العلم. علما أنه يحتاج إلى دراسات أعمق وأشمل من دراستي هذه. والله أعلم وأحكم.  إشكالية البحث والجواب عليها:  فقد ألف الإمام الحجاوي " الزاد" مختصرا جدا، وبناه على قول واحد، كذا ذكر في أوله، كما سبق. ولكن! هل ذكر الخلاف في كتابه؟ من نظر إلى شرطه في "المقدمة"، يفهم أنه جرده من الخلاف ذكرا (صريحا)، أو إشارة، لأن ذكر الخلاف، متناف مع قصد الاختصار، والاعتماد على قول واحد، ولن يفهم من مقدمته غير ما ذكرت. وهذه عادة غالب كتب المختصرات الفقهية. وعند قراءة " الزاد" من أوله إلى آخره، سنجد أن مصنفه تقيد بشرطه فلم ينص على الخلاف صراحة. ولكن نجده أشار إلى الخلاف في مواضع كثيرة، مرة تصريحا، ومرات إشارة، وقد استخدم -عند إشارته عدة استعمالات وهذا ما جعلني أعقد هذا المطلب". قلت: وهذا الذي جعلني أتناول هذا الموضوع في بحثي هذا.  خطة الموضوع: يشتمل هذا الموضوع على مقدمة: وتحوي على أهمية الموضوع وأسباب اختياره والدراسات فيه. ومبحثين وخمسة مطالب وخاتمة وفهرس المصادر والموضوعات. وفي هذا البحث: إبراز شخصية الإمام الفقيه الحجاوي الفقهية، فقد كانت شخصيته شخصية الناقل الحر، والناقد البصير والكاتب المجتهد. رغم عدم نص الحجاوي في كتابه " الزاد" بذكر الخلاف في المذهب، بيد أنه أكثر من إشاراته للخلاف في المذهب مستخدما الإشارات التالية:  1-	حروف الخلاف الثلاثة المشهورة وهي" لو، وحتى، وإن".  2-	استخدم مصطلح المذهب العلمي وهو: "ظاهر المذهب" مرة واحدة فقط. 3-	استخدم أسلوب النفي ليدل به على الخلاف في المسألة.  فقد لوحظ -كما مر في دراسة هذا البحث استخدامه واستعماله لإشارات الخلاف المختلفة والمتنوعة في المذهب، بحسب مدلولاتها في السياق، وأثراها إثراء كبيرا مما يدل على نبوغه البالغ في معرفته بالمذهب الحنبلي، بل صار إمام الحنابلة في وقته رحمه الله.
                  In the name of Allah, the Most Gracious the Most Merciful the uses of Jurist Mossa AlhaJawai in his book zad al mostaqana in the brief of al moqana' for the sighs of difference and its cpressions in the al —hanbali doctrine By Dr- Abdullhah Mohsen Al-hadhrami, specialization of fiqh and usul Al fiqh.  Preface: praise be to Allah, lord of the worlds and peuce and blessings be upan our sincere por phet and his family and cempanions .  The Ong in of zad Al- mosta qana in the brief of Al- moqana ' is the most famous of Al hanboli is lamic know ledge among the latst scholars and it be cames more common in al-hanbli dis tricts' Arab is land especially in najcd.  There is on such knowledge has been com posed asit is satu rat eel with juristic explantion- inspite of its small size, it is risch of Juristic elarificotion it has indicated the signs of differences in Al-hanbli doctrine and shed light on its uses- however it has not stated to it clearly. Mentioned, lcencern on the se signs to got aeon sequence in knowing its references. Lmam' lbn Qod ama ' showed his two opinions.in tndg ing in some Juristic topics but Al-haJawai may Allah forgives him chose what he noticed better without showing the other opinion although hi in dicated the difference in the doctrine. What I will show in this research that Al- haJawai has men tioned the letters of differences in Al- hanbli doctrine in ascien tific can cept zahar of doctrine 'and in negative style as its positions will be shown soon. This topic needs Juristic studying to get aseienti fic result about its way in using these gifferent letters and the refo ren ces off eash letter for this purpose l has fowsed on my studying on this con cept to provide myself and my stndents what lightens our minds. What is wrong in this re search and how itis presented. When l mam Al-haJawai composed this 'zad'it was abbreviated and cens tructed in only one opinion that makes it ccnderstood as it has been stripped of from the mentions of difference explicitly or even in assign as it was done in all abbriviateel Juristic books . However this 'zad' in dicated the difference in several positions, which has a lot of uses and this, makes me can cent rate en this topic in my research.  The lay out of this research: This research can sists of in trochucti on which shows the magni fecence and the importance of this topic and why it has been chosen. It has also the five demands conclusion and index of the sources and the topic self in this research ,there is the showing of the character of the Jurist Al- haJawai who is the free com poser the clever critic and the adept writer who has pointed to the signs of difference which are: The famous three articles 'if even' and to -The use of definition of scientific doctrine 'zahar' of the doctrine for only one me .  The use of negation to show difference He in dicates to the various uses of differences in the doctrine according to its reference and his attempts in enriching them which refers to his great know ledge of Al-hanbli doctrine . he beeame the 1 mam of Al-hanablah at his time
