 الحق في التعليم هو حق أساسي من حقوق الجيل الثاني، وهو يدخل في زمرة الحقوق الثقافية، والهدف الأساسي من هو تحسين المستوى المعيشي للمواطن الأمريكي بالدرجة الأولى ، غير أن هذا الحق يواجه تحديات جمة نتيجة الفوارق الكبرى التي تتميز بها القارة، فقد تم انتهاكه بشكل كبير خاصة في الدول التي تعاني من الفقر بسبب انتشار الحروب والعصابات المسلحة وتجار المخدرات، ولحماية هذا الحق كغيره من الحقوق وعلى أساس أن حقوق الإنسان وحدة لا تتجزأ فقد كرسته الدول الأمريكية في وثائقها المختلفة لحقوق الإنسان والوثائق ذات الصلة، ولم تكتف بهذا فأنشأت آليات تكفل حمايته، ومن بين هذه الآليات المحكمة الأمريكية لحقوق الإنسان التي أعطي لها الحق في النظر في قضايا انتهاكات حقوق الإنسان ومن بينها الحق في التعليم.
                  The right of education is a fundamental right which functions as a multiplier, enhancing, all rights and freedom when it is guaranteed while jeopardizing all when it is violated. This right faces a big confrontations especially in countries whose suffer from civil wars, crimes, gangs, drugs trafficking…, because all this phenomena affect on enjoying  of right of education.       Most of  countries of american continent has protect this right by authentication on human rights pacts which include the right of education, no that only but they admit the  competence of the human rights mechanism protection  especially the Interamerican of  human rights court , this last has seen in several education violation cases
