Abstract:

 نتيجة تدهور النسيج العمراني وتشويه الجمال العمراني من قبل البنايات الغير مكتملة والغير مطابقة للرخص صدر قانون المطابقة رقم 15-08 ، حيث نص على أن كل مستفيد من رخصة البناء عند الانتهاء من أشغال البناء وأشغال التهيئة باستخراج شهادة المطابقة للأشغال المنجزة مع أحكام رخصة البناء، لكن أمام عجز الإدارة على التحكم في البناء العشوائي وضخامة مشكل البناء الغير شرعي اتخذت الدولة تدابير جديدة لتسوية وضعية بعضها، مما يجعل القانون رقم 15-08 قانون تسوية أكثر من مطابقة نتيجة الواقع العمراني الدنيء.وعليه فان تفعيل قانون المطابقة وتطبيقه يتطلب تفعيل دور الهيئات الرقابية وصرامة الجزاءات المفروضة على المخالفين والعمل على تكريس وعي عمراني لدى المواطنين.


ABSTRACT:	
As a result of deterioration of urbanfabric and distorsion of urban beauty by incomplete and non-conforming buildings, the conformity law No° 15-08 was issued, Where it is stipulated That each beneficiary of the building permit upon the completion of the construction Works and the preparation Works by extracting the certificate of conformity to the Works performed with the provisions of the building permit ,However, in the face of the administration'sinability to control the illegal construction and the enormous illegal construction problem, the state has taken new measures to settle the status of some of them. Law No°. 15-08 makes the settlement law more than the result of poor urban reality. There fore, the activation of the compliance law and its application requires activating the role of the super visory bodies and the severity of the sanctions imposed on the violators and work to devote public awareness to citizens.
