Abstract:

Muhaddiths, who have been trying to benefit from the most ideal methodologies in the science of ḥadīth, have contributed to this science for generations, enriched the methodologies developed by a cumulative process and achieved a lot in discriminating between authentic ḥadīths and inauthentic ones. For that reason, it comes to mind if the methodology of arbitration, which has a past as deeply rooted as human history and appears as a method used for all kinds of issues of people in communities, has been adopted in narrations. As this methodology was impossible to be adopted during the era of the Prophet and his companions, it needs to be analysed when the methodology of arbitration started, in which periods it escalated and how it was adopted. The analysis of the methodology of arbitration, which is really limited in terms of being binding and the power of enforcement, appears as another crucial issue with regards to the opportunity to apply it on the both sides of the ḥadīths analysed for both wording and meaning. Following the ascertainment of the use of the methodology of arbitration in ḥadīths narrations, if the detection of both how this practice has been adopted and which samples have been used is possible, it will be easy to view the contributions it will make to the science of ḥadīths. When the practices of arbitration remain limited again, it gains significance to ascertain the method adopted in the science of ḥadīths methodology and to specify what factors give rise to this. Consequently, to what extent the methodology of arbitration is adopted in the science of ḥadīths in conjunction with its contributions to this science will have been ascertained by means of a multi-faceted analysis.
