Abstract:

The first step of being a family is a person asks for the girl‟s hand in marriage. This takes place in the basic
hadith sources as the subject of the earthworks. Imam Malik‟s hadith book named el-MUVATTA that is one of the
trustworthy hadith source is accepted as both one of the first hadith source and islamic law book. The topic of our
article is the hadith of „‟If one of your Muslim brother ask for the girl in marriage , the others do not ask the same
girl‟ . In this study it was tried to determine whether some people can aspire a girl at the same time or not , or if it is
possible , which step is suitable to aspire the same girl? We will try to scrutinize this topic that keeps up to date in
every term.
The meaning of „Hıtbe‟ is „‟asking for the girl‟s hand in marriage‟‟as a vocabluary and it means people who
thinks about getting marriaged aspire to each other. This Notion can be come across the term of „engagement‟in
classical and modern sources. Because of this reason, even if the terms of „Hıtbe‟ and engagement was used
interchangably in some sources, nowadays, the term of engagement exprees the stage that starts with the proposal of
marriage after Hıtbe.Actually, both of them consist of processes followingeachother.
This Hadith came from two diffirent way that is in el Muvatta and it will be conveyed by basing on Kütübü‟s
– Sitte. In the next step, it will be try to determine validity of the hadith in terms of „deed and text. Besides, in our this
study, in the first step of the marriage, we tried to evaluate This hadith by basing on Prophet Muhammad (PBUH) „s
lines at wedding proposal and opinions of denominations after determaning the people who is made an offer.

Her dönemde
Hz. Peygamber‟in (sav.) koyduğu sınırlar çerçevesinde ve mezheplerin görüşleri doğrultusunda değerlendirilmeye
çalışılacaktır.
