Abstract:

This article deals with the meanings attributed to the concepts of “cultural offense”
and “cultural defense” in the legal literature, and with the arguments raised
in favor of or against the recognition of the cultural defense. The debate surrounding
the issue figures out the conflicting premises of the legal ideas, the difficulty
in balancing them and in realizing that balance in the criminal courts of contemporary
multicultural societies. The compelling need to overcome the problems
of clush of cultures forces the legal systems to change or to adopt new forms of
interpretation in line with multicultural social reality.
