Abstract:

 يظن البعض أن الكتابة في حقوق الإنسان سهلةً، لكن الحقيقة ليست سهلة، بل تحتاج إلى المعرفة التي تجمع بين الرواية والدراية، ولاسيما في الإسلام، المستنبطة أحكامه من قواعد أصولية سندها الوحي الإلهي من كتاب وسنة, وما أجمع عليه علماء السلف وبقية القواعد المستنبطة من اجتهادات الفقهاء. وبالتالي؛ فإن الأمر يحتاج إلى جهد غير عادي للكتابة في هذا المجال، وقد عزمت أن أكتب في حقوق الإنسان وفق التصور الإسلامي فمضيت في تقسيمها إلى ثلاثة محاور: تحدثت في المحور الأول عن محل هذه الحقوق وهو الإنسان، وكيف اهتمت الشريعة الإسلامية بالإنسان أولاً، ثم بينت في المحور الثاني أساس حقوق الإنسان في الإسلام المنبثقة عن وحدة المصدر ووحدة الوجود .. بعد ذلك أوضحت في المحور الثالث مدى انعكاس هذا التصور على واقع حقوق الإنسان، وقد كانت دراستي هذه في أغلبها مقارنة بما هو عند الغرب والاتفاقيات الدولية المعنية بحقوق الإنسان، وقد توصلت إلى عدد من النتائج أتبعتها بعدد من التوصيات علها تسهم في تصحيح النظرة إلى حقوق الإنسان في الإسلام.

Abstract
Some believe that the writing on human rights is easy, but the truth is that it is not easy. Rather, it requires, especially in Islam, the knowledge that combines the narration and the knowledge, which its provisions have been derived from fundamentalist rules supported by: the divine revelation of the Holy book and Sunnah, all Salaf scholars agreed upon them, and the rest of the rules derived from jurists' insights. Therefore, it requires an extraordinary effort to write in this field. However, I intend to write on human rights in accordance with the Islamic perception, and I divided it into three axes:
I wrote in the first axis about the essential of these rights, which is the man, and how Islamic law (the sharia) did take care of the man first. In the second axis, I elucidated that the basis of human rights in Islam has been emerged from the unity of the source and pantheism. Then, I explained, in the third axis, the extent of the reflection of this perception on the reality of human rights. This study was mostly in comparison with what is in the West and international conventions on human rights. Thus, I have reached a number of conclusions, followed by a number of recommendations that they may contribute in correcting the perception of human rights in Islam.

Résumé de la recherche:
 Certains pensent qu'il est facile d'écrire dans les droits de l'homme, mais que la vérité ne l'est pas, mais que le savoir qui associe le roman et le savoir, en particulier dans l'islam, dérive des règles du fondamentalisme étayées par la révélation divine du Livre et de la Sunnah, ainsi que de tous les érudits salafistes et du reste des règles tirées de la jurisprudence Juristes.
Par conséquent, il faut un effort extraordinaire pour écrire dans ce domaine, et j’entends écrire dans le domaine des droits de l’homme conformément à la perception islamique, et je l’ai divisé en trois axes: j’ai parlé du premier axe de la place de ces droits, Dans le deuxième axe, j’ai expliqué l’ampleur de la réflexion de cette perception sur la réalité des droits de l’homme, et cette étude était principalement en comparaison avec ce qui existe en Occident et avec les conventions internationales sur les droits de l’homme. Je suis venu avec un certain nombre de résultats A formulé un certain nombre de recommandations qui contribuent à corriger la perception des droits de l'homme en Islam.
