Abstract:

Each science has its own principles, sources, and rules, by which branches are linked to the fundamentals and the new to the old. Every science needs assets that control it and rules that regulate it. However, setting these principles and rules and distinguishing them from others is the result of a specific conception and a clear intellectual system, which is expressed by logic or belief, so it is the adopted intellectual system that draws the features of the followed fundamentals and the rules that are in force. Man’s original fundamental orientations are drawn by his theoretical logic and his intellectual structure. He is the one who tends to guide the practical legal part. Before the principles of jurisprudence or the principles of law, there is the logic of assets or the philosophy of law. This will be explained in this article, in addition to the clarification of the concept of the fundamentals of View and the principles of thought in the Islamic legislation.
