Abstract:

 :Abstract
Electronic advertising has become an indispensable means in economic life, especially in front of the openness of international markets and the escalation of competition, so it received the attention of legislation, including the Algerian legislation, which tried to establish a legal framework for it organized through the Electronic Commerce Law 05/18. This study aims to identify the provisions and controls regulating electronic advertising in this law, and to know the extent of the effectiveness of these provisions in controlling this process and in protecting the electronic consumer as the weakest party in this relationship.
The study concluded with several results, the most important of which are:
The legislator, despite his attempts to provide adequate protection to the consumer by setting regulating provisions for electronic advertising in Law 05/18, was not sufficient to achieve the desired goal. It has not been exposed to advertisers who broadcast their advertisements through online stores, and whether they can be considered suppliers, most of them do not have a commercial registry. The penalty for violators of the legal terms and conditions regulating electronic advertising is simple and unchecked, which poses a threat to the interest of the consumer.
