Abstract:

 ملخص المقال:
 يُعد الإفراج المشروط أحد أهم أساليب المعاملة العقابية الحديثة؛ الذي يسعى إلى تحقيق أغراض العقوبة المتمثلة في الإصلاح وإعادة تربية والتأهيل الاجتماعي للمفرج عنه شرطيا. فهو عقوبة بديلة ينطوي على التغير في كيفية تنفيذ العقوبة السالبة للحرية، باعتباره نظام انتقائي يحول دون استمرار تواجد المحبوس في المؤسسة العقابية؛ فينفذ جزء من العقوبة داخل المؤسسة العقابية والجزء المتبقي من العقوبة خارج أسوار السجن. ولكن مقيد بتدابير والالتزامات، كما تقدم له المساعدة المعنوية والمادية من أجل الوصول إلى الهدف المنشود من العقوبة ألا وهو الإصلاح وإعادة التأهيل الاجتماعي، وقد تضمنه المشرع الجزائري من خلال المواد من 134 إلى 150 من القانون رقم 05-04 المتعلق بتنظيم السجون وإعادة الإدماج الاجتماعي للمحبوسين. 
 
Conditional liberation is one of the most important methods of modern punitive treatment, which aims to achieve the goals of repression and the re-education and social reintegration of the released police officer. It is an alternative sentence involves a change in the way of implementing deprivation of punishment freedom, as a selective system prevents the continued presence of the prisoner in the penitentiary, part of the sentence is implemented at the within the penitentiary and the remaining part of the sentence outside the walls of the prison. However, the restrictive measures and commitments, and give him the moral and material assistance to achieve the desired goal of punishment, namely reform and social reintegration, was guaranteed by the Algerian legislator by articles 134- 150 of the law n ° 05-04 on the organization of the prisons and the social reintegration of detainees.
