Abstract:

This study undertakes the compilation and analytical examination of the authoritative positions (tashhīrāt) articulated by Ibn ʿAskar in his work al-ʿUmdah, focusing on the chapters of purification (ṭahārah) and prayer (ṣalāh). The study seeks to elucidate Ibn ʿAskar’s scholarly standing within the Mālikī school of law and to assess the extent to which his authoritative positions have been relied upon by later jurists. It further aims to collect, classify, and analyze his tashhīrāt in the aforementioned chapters. To achieve these objectives, the study adopts a combination of methodological approaches, namely: the inductive method, the descriptive method, the analytical method, and the transmissional (naqlī) method. Among its most significant findings is that Ibn ʿAskar is counted among the last generations of scholars known for issuing authoritative endorsements (tashhīr). His positions were adopted and relied upon by subsequent scholars, and in the majority of cases, he follows the authoritative opinions of earlier imams of the Mālikī school. Moreover, all of his tashhīrāt within the scope of this study are deemed acceptable and valid. His positions are largely consistent between his two works, al-ʿUmdah and al-Irshād, with the exception of a limited number of instances in al-Irshād where he diverges from the well-known (mashhūr) position or merely reports juristic disagreement without issuing an authoritative endorsement.
