 ملخص: 
اتجه المشرع الجزائري في التعديل الدستوري الجديد 2020 إلى تكريس الأمن القانوني بشكل كبير مقارنة بالدساتير السابقة، حيث كرس حوالي 54 مادة كاملة لحماية الحقوق والحريات، أهمها حرية الدخول والمشاركة في الطلب العمومي من خلال حماية المبادئ العامة للصفقات العمومية وهي الشفافية في الإجراءات، المساواة بين المترشحين وحرية الوصول للطلب العمومي، فتحوّلت ولاية التشريع في مجال الصفقات العمومية من السلطة التنفيذية الى البرلمان، حسب أحكام المادة 139 الفقرة 10 من دستور 2020. بهذا تحولت طبيعة النص قانونيا من نص تنظيمي الى تشريعي، أي أصبح قانونا بعد ما كان لائحة يصدرها رئيس الجمهورية في شكل أمر أو مرسوم رئاسي، 
Abstract: 
In the new constitutional amendment 2020, the Algerian legislator sought to enshrine legal security in a significant way compared to the constitutions that preceded it, as evidenced by the fact that he devoted about 54 full articles to the protection of rights and freedoms, among the most important rights is freedom of entry and participation in public demand by protecting the general principles of public transactions, namely transparency in procedures, equality between candidates and freedom of access to public application, by orchestrating rules on public transactions. And transfer the mandate of legislation in the area of public transactions from the executive to parliament, in accordance with the provisions of Article 139, paragraph 10 of the 2020 Constitution.
In this way, the nature of the text has been legally transformed from a regulatory text to a legislative text, i.e. it became law after what was a regulation issued by the President of the Republic in the form of a presidential order or decree,.
